The controversy is destroying the institution’s reputation and public trust in it, judges should be declared constitutional benches until the 26th Amendment is decided
Senior judge of the Supreme Court of Pakistan, Justice Mansoor Ali Shah, opposed the extension of the term of the Constitutional Bench.
According to the report, a letter written by Justice Mansoor before the June 19 meeting has come to light, and Justice Mansoor’s letter to the Judicial Commission members was delivered.
According to the text of the letter, the extension should not be extended until the 26th Amendment case is decided. It was informed in advance that he was not available in Pakistan for the June 19 meeting. It was expected that the meeting would be postponed due to unavailability.
The letter said that in the past, the meeting had been postponed due to the absence of the executive members. Since the judiciary members are in the minority, they may not have been able to postpone it. Extension before the 26th Amendment decision will further deepen the crisis.
It was further said that this dispute is destroying the reputation of the institution and public trust in it. Until the 26th Amendment decision, all judges should be declared Constitutional Benches. The criteria and criteria for inclusion in the Constitutional Bench should also be determined.
